We respond to valid copyright complaints and we terminate repeat infringers.
Filing a notice
Send a written notice to our designated agent at the address on our contact page, including all of the following. An incomplete notice may not be actionable.
- Identification of the copyrighted work you say is infringed.
- Identification of the material on this site you say infringes it, with enough detail — a URL — for us to locate it.
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief the use is not authorised by the rights holder, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the rights holder or authorised to act for them.
- Your physical or electronic signature.
Misrepresenting that material is infringing can make you liable for damages, including costs and legal fees.
What we do
We acknowledge receipt, and where the notice is complete we remove or disable the material expeditiously and notify the affected member. We record every notice, what we did, and when.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice containing your contact details, identification of the removed material and where it appeared, your signature, and a statement under penalty of perjury that you have a good-faith belief it was removed in error. You must also consent to the jurisdiction of a court where you are located.
We forward a valid counter-notice to the original complainant. If they do not tell us within 10 business days that they have filed an action, we may restore the material.
Repeat infringers
We keep a record of notices against each listing and each account. An account or a vendor that accumulates repeated valid notices is terminated. This policy is applied consistently — it is a condition of the safe harbour we rely on.
A note on the GPL
Many complaints in this category are not copyright infringement at all. The GPL expressly permits redistribution, including commercial redistribution, and a product's author cannot withdraw that permission for code already released under it. Where we believe a notice targets lawful GPL redistribution we will say so and ask you to reconsider — but we will still record it, review it properly, and respond.
